What Dwell is
Dwell is a service provided by Spark Technology, Inc., a Delaware corporation ("we," "us," "Dwell"). It measures how visitors engage with your web pages (impressions, click‑through, dwell time) and helps you run SEO experiments. You install a small JavaScript snippet on your pages, optionally connect Google Search Console, and view results in a web dashboard.
Your account
You must be at least 18 years old to create a Dwell account. You're responsible for the security of your login credentials and for anything done with your account. Tell us right away if you think your account has been compromised.
Your data
You own the data you send to Dwell — the beacons your snippet emits, the Search Console data we pull on your behalf, and the experiments you configure. You can delete a site at any time from settings, which purges all data associated with that site.
You grant Dwell the rights it needs to store, process, and display your data back to you as part of providing the service. We don't sell your data or share it with third parties beyond what's needed to operate Dwell (see the Privacy Policy).
You are responsible for obtaining any consent required by applicable law (for example under GDPR or CCPA) from your site's visitors before installing the Dwell snippet.
Our software and brand
Dwell retains all rights in the Dwell service, software, documentation, logos, and name. Nothing in these terms transfers ownership of those to you. You retain all rights in the data you send to Dwell.
Indemnification
You agree to indemnify and hold Dwell harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of Dwell, your content, or your violation of these terms.
Acceptable use
Don't use Dwell to break laws, harm others, or circumvent search engine guidelines in ways that could hurt other sites. Don't install the snippet on sites you don't own or control.
Service availability
Dwell is provided as-is, without warranties. We try hard to keep it up and correct, but we don't guarantee uptime, data accuracy, or freedom from bugs. Search Console data is subject to Google's own delays, rounding, and privacy filters — Dwell surfaces what Google gives us.
Changes and termination
We may change these terms, the service, or pricing. Material changes get advance notice by email to the address on your account. Continued use of Dwell after changes take effect constitutes your acceptance of them. You can stop using Dwell at any time by deleting your sites and account. We may suspend accounts for terms violations.
Limitation of liability
To the extent allowed by law, Dwell's total liability to you is limited to the greater of one hundred US dollars or what you've paid us in the last twelve months. We're not liable for indirect, incidental, or consequential damages.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from these terms or from your use of Dwell will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
